Voter Intimidation

Tucson, Pima County, Arizona

A message was left on voter's phone telling him to go to the wrong polling place. He used the "last number called" phone service and got the Republican Headquarters. Voter gave them his son's name (son a registered Republican) and was told it was a "terrible mistake" and was given the correct polling information. He heard one other person who also received a phone message with the wrong polling place. EP volunteers phoned Republican Hdqtrs (321-1492), told them of call. Person answering said they had heard that someone was leaving their number. EP volunteer advised the Republican Hdqtrs of the use dof the callback feature. Also see case 031651 - complaint to EP in San Francisco, CA that lots of people sent phone messages with wrong polling place.

Voter Intimidation

Tucson, Pima County, Arizona

Voter received call yesterday of "new polling place". Voter showed up at #27, far from her home. This is the 2nd person our EP volunteer encountered. 1st was male who received a letter in the mail appearing to be from Pima Cty. Another EP volunteer at this precinct has co-worker who received call identifying themselves as calling from RNC reminding her to vote at wrong precinct. Voter knew this was wrong and contacted the RNC local HQ and AZ Star reporter.

This voter complained that yesterday he received a call from a person named Mark Leftler from the Republican Party directing him to the wrong precinct. He claims that he knows several people this has happened to. ***He has the message recorded at his house.*** He talked to "Tom" at command center (Tom Carr) and gave him the contact information. He did NOT cast his vote at the wrong place. Two representatives from the county "Division of Elections" (Laura is one of them) came to listen to his complaint and said that they would report it.

Malfeasance

Holy Trinity Lutheran Church 5951 S 12th , Tucson, Pima County, Arizona

Member of National Council of La Raza went into poll to make sure that there were Spanish ballots available. The marshall said he didn't have time to tell him and asked what gave him the authority to ask. He replied as a U.S. citizen he had the right to ask. Marshall said he didn't have to tell him anything. A Democratic poll monitor was also present. When member of NCLR left, after getting angry and swearing at Marshall, Marshall angrily complained that he had "all these damned Mexicans lining up to vote and that they were taking away all of our rights." Marshal was also giving Demo poll monitor a hard time, at one point ordering her to leave the building. She was trying to explain the rule of provisional ballots to Marshall, who didn't know the rules. He later told Demo poll monitor that he had "caught" an incorrect provisional ballot but that 3 had previously gone through and would be invalidated. There had also been a female voter who was turned away and not allowed to vote on a provisional ballot, per the Demo poll monitor.

Possible malfeasance

Our Lady of Lavang Church, 800 S Tucson Blvd, Tucson, Pima County, Arizona

At polling place poll worker checked caller in the log book and he signed. Another gave him his ballot, but he noticed that there were extra poll workers writing down what he thinks were voter names in another log book that was not getting signed by the voters. Doesn't know what the other log book was. He waited for the poll worker to write down his name but she didn't instead she told him to go ahead and vote. He thinks he voted -- filled out ballot and put it into the machine. No receipt. Caller is concerned with why the poll workers were writing down names in another log book, he has never seen that before. He is also concerned that their failure to write down his name will impact whether his vote is counted.

Scanner rejects ballots. Poll officials then tell voters to put ballots in upside down. Ballot was then accepted. Voter is concerned that this means the machine could not have scanned his vote and recorded it properly. He thinks it may be a systemic problem. Voter was told that the scanner did not count the votes; if it does, he is concerned that anyone who inserted ballot upside down would not have a vote counted or improperly counted.

Reported via e-mail to eirhelp: When I finished filling out my paper ballet this morning I tried to feed it into the Diebold counter and it wouldn't take it. Election officials couldn't get the machine to work so I, and everyone behind me, placed our ballots in a compartment on the side of the machine "to be recorded later." Caller went to assigned polling place in Pima County around 6:30-7:30 this a.m. He is registered in Pima County and has voted in it before. The poll workers told him he had requested an early ballot (they had his name on a list with an "e" next to it), but caller says he never requested one. Poll workers had him fill out a form -- a provisional ballot? -- and they said he would be notified by mail if his vote counts or not. Also, when the caller filled out the provisional ballot information, the poll workers said, "with an attitude," "You're a democrat?" in a tone implying there was something wrong with it.

Voter Intimidation

Tucson, Pima County, Arizona

Two women from the Grijalva campaign drove up behind a guy whom they had followed from another precinct. Someone had reported that this guy was asking people if they were citizens as they got out of their cars at the polling place. He was asking to see their ID and had a cameraman with him who would stick his camera in their faces (up to 6" away) as he asked. When he arrived here, he was alone, except for some press people who were interviewing/filming him. We didn't see him approach any voters. He wears a black tee shirt with "US Constitution Enforcer" in yellow letters. He has a military style belt which gives the appearance from afar that he is armed but he is not. FOLLOWUP NOTES: Two additinal cTV crews came after the first two left. Seem to be disruptive and intimidating voters. A van drove up with a man and a woman in it who stopped, looked at the "hub bub" in the parking lot for a while and then drove away. ([possible voters?) A couple who did vote told us that the poll workers are talking loudly to one another and to voters about what is going on outside - loudly enough to make it difficult to concentrate on the ballot.

Pima County Voter Registrar Chris Roads said on the program that out-of-state students are committing a felony if they register to vote in Arizona and they don't intend on remaining in the state "indefinitely." Students consulted attorneys and held a press conference last week declaring that it was perfectly legal for out-of-state students to vote in Pima County as long as they've lived here 29 days. Even Pima County Recorder F. Ann Rodriguez backpedaled from Roads' statement in comments last week to the Arizona Daily Wildcat.   http://www.votersunite.org/article.asp?id=3868
