She indicated that voters are getting frustrated and leaving the polling place without voting.

Voters at a voting station in Pompano Beach discovered at the last minute their precinct, 1C had been moved from the Pompano Beach Civic Center to a nearby church. The discovery was made after an unknown number of voters had cast provisional ballots at the Civic Center. Precinct 1C has 1,200 registered voters. A similar problem was discovered Tuesday morning at Precinct 72Q in Weston, which has 1,920 voters. In the Pompano Beach case, neither the clerk nor the voters said they were aware of the address change. The Broward Elections Office was attempting to identify the voters who had cast their votes, telephone them and then have them go to the new 1C polling precinct at St. Stephen Lutheran Church, 2500 NE 14 St., to cast official votes. If they don't re-vote, the ballots cast at the Civic Center will not be counted.

However, when she tried to accompany me into the polling place, a man wearing a tag identifying him as a "poll watcher", challenged the womans's right to accompany me into the polls as I had expressly requested her to do. The woman told me her name. I do not know the name of the man who challenged me within the 50 feet radius of the polling place. The Republican poll watcher insisted on challenging the man's vote even after the supervisior of Election's confirmed that it was improper to drop a person from the rolls for the reason. [P]

We had calls about a road block, put up by the police at 7am on Nov. 2, which blocked road access to two precinct locations in majority black districts. There was no justification for the road block--no accident or crime scene or construction. Many of our calls dealt with voter suppression, or manipulation, of the Haitian population--occurrences which seem too numerous, and their targets too indefensible, as primarily poor, first-time-voter, Creole-speaking refugees, to be anything but systemic. In one example, a voter whose hands were bandaged could not press the touch-screen himself; he asked the nonpartisan election official to press "Kerry" for him, but the election official pressed "Bush" and sent his vote immediately into the machine. Many, many others were denied the right to vote and were not given provisional ballots, while others were refused assistance at the polls, even though provisional ballots and voter assistance are legal rights. Others were told they had already voted and were turned away, although they had never voted previously. This latter experience was a complaint not isolated to Haitians but also included other surprised voters with no recourse except their word against that of the Supervisor of Elections

As a citizen, and someone with a B.S. in Computer Science, I've been greatly concerned about the accuracy of electronic voting machines. Having worked with computers for decades in my own business, I know how vulnerable they are to both incompetence and tampering. So I always do everything I can to cross check and verify the numbers in my precinct, and the numbers in this election do not add up. 553 people voted on the machines in Precinct 11R, but the machines only registered 536 votes cast. Here are the details: I've worked with the same crew for a couple of elections now and we all care very much about making sure that everyone who is entitled to gets to vote, doing the best job we can to ensure the accuracy of their votes, making sure voters know how to use the machines, doing all the paperwork accurately and thoroughly, etc. Due to our Assistant Clerk taking sick early in the day on November 2, 2004, the Clerk asked me to take over as Assistant Clerk for Precinct 11R, and part of my responsibilities that day were to count and tally all the voting slips in our precinct. I was also directly involved with bringing up the ballots on the machines, preparing provisional ballots and affirmations for voters, logging those voters, contacting the elections office, and other tasks throughout the day. In this election we had 541 voters who signed the precinct registers. Additionally there were 14 people who were not on the registers who filled out pink affirmation forms; for these voters we called the elections office and got an approval code for each one, enabling them to vote on the machines. One person who signed a pink affirmation form voted with a provisional ballot rather than on the machine, which can be verified through the Clerk's Voters Log and also by looking at that voter's provisional ballot. So 13 people who signed affirmations voted on the machines. Each of these voters received a small slip printed on gold paper which was then given to an election worker, who brought up a ballot for them on the machine. Election workers also verified that each of these people had completed their ballot when they left the voting machine. There were also 18 people who voted with provisional ballots, these people did not receive the little gold paper slips and did not vote on the machines, so I am not including them in these tallies. Voters who signed affirmations or voted with provisional ballots were also logged into the Clerk's Voters Log and the numbers can be verified that way as well. We used a separate book of gold slips for the voters who signed affirmations so that can also be used to cross check the number of voters who signed affirmations and voted on the machines. All the various options with affirmations and provisional ballots these days make things a little more complicated and confusing. I tried to reconcile the numbers on election night but I could not, and this disturbed me greatly, but I thought perhaps I was just confused by all the variables because of the affirmations, provisional ballots etc. However, I looked at the numbers again the next morning, and the discrepancy in the numbers in our precinct can be distilled clearly as follows: The total number of voters in Precinct 11R who were approved to vote was: 541 - signed precinct register 13 - signed affirmations for a total of 554 voters. We had 553 gold slips returned, so probably one person left the precinct with their slip without voting, which could have easily happened as our lines both inside and outside were very long, and in the crowd near the front door, where the end of the line was for people who had already signed in and received slips, someone could have left without us knowing it. So these figures are consistent, we had 554 voters who were entitled to vote on the machines and received gold slips, and 553 of them did exactly that, as verified by these two different ways of counting voters, as well as by pollworkers who assisted them, collected slips and verified that each voter had completed their ballot. However, at the end of the night, the machines registered only 536 votes cast. That is a difference of 17 votes. 17 votes out of 553 is over 3% of the vote simply not counted. I have no way of knowing if there were additional problems with the accuracy of the votes cast, but it's clear that, at the very least, over 3% of the votes in Precinct 11R were not counted. All of the numbers detailed here were counted, recounted and verified by several pollworkers, and can easily be verified in several different ways using the paper records from our precinct. I kept the scratch paper where I made these calculations and can make that available if needed. Our original Assistant Clerk logged in the serial numbers of all the books of voting slips at the beginning of the day, and we both marked off each book of slips as it was used. So the number of gold slips used can also be re-verified that way. This log of voters' slips was returned to the Supervisor of Elections with the voters' slips (used and unused), affirmations, provisional ballots, precinct registers, Clerk's Voters Log and all other materials. Therefore please include Broward County, Florida Precinct 11R in your research and Freedom of Information Act requests. Please let me know how I can be of assistance with your work. If you need more information or clarification about my experience in the precinct, or if there is anything I can do here in Broward County, please let me know. It is very clear that the votes in my precinct were not counted accurately in this election, and that is unacceptable. She attended "Logic and accuracy testing" training-- none of the early voting machines were present at the Logic and Accuracy testing. None of the spanish language machines were present at the logic and accuracy testing. Most flagrant problems are at the Coconut Creek precinct at the North regional-BCC (Broward Communiyt College) Library. She asked a series of questions and they wouldn't answer. She noticed issues re: absentee ballots. At the BCC Library they are accepting absentee ballots and they are putting them in an improper container and are handling the absentee ballots improperly. Today they won't tell her where absentee ballots are being stored, etc. They weren't logging in affirmations of early voters. Before the voting started, they are accepting absentee ballots at the early polling sites in violation of the regulations.

When she went to the clerk another voter's signature came up next to her name. The election official asked her if she had registered at the DMV, because three other voters who had registered at the DMV had similar problems that day. The voter had not. Voter was asked to fill out an extra form (yellow) and was then allowed to vote on the touch screen machine. As far as she knows, this was not a provision ballot. However, she is concerned that her vote will not count.

EP Hearing(affidavit) ,Cheryl Grenning, Testified on behalf of her son who is a student at UCF. We agreed that the best situation for him was to maintain his registration at his home address in Florida and vote by absentee ballot. He began calling the supervisors office in Broward County on August 18 and called many times and spent more than 40 minutes of cell phone time over several days trying to get an absentee ballot sent. But he was never able to actually talk to anyone about sending him a ballot. So she looked into what he had to do and suggested he register over the internet. He registered over the internet on Oct 15. But with the election fast approaching they began to worry when he never received a ballot. They looked into other options and decided to call Senator Nelson’s office, who called the Broward S.O.E. office and assured us that a ballot would be Fed-Exed on Oct 27. He went to the office to get it and stayed all day but it never came.

EP Hearing(affidavit), Marsha Ellison, Ft. Lauderdale NAACP, We had reports from many who were unable to get absentee ballots in Broward County, but also many who then went to the polls were improperly not allowed to vote by officials. Where to take absentee ballots in last few days of election was not clarified and many did not know what to do. Many votes not counted. An African-American precinct was completely black with no lights outside and in parking lot so voters could not know where it was and that it was open. Many submitted registrations or change of addresses on time but got no voter cards. No one at the polls told the voters their proper polling place and they were not properly informed on this. Many did not get to the proper polling place. Many were not allowed to vote provisional ballot and officials did not follow proper policy on this. Poll workers would not help them determine their proper polling place, and told to call S.O.E. office but most could not get through to it.

EP Hearing(affidavit), Ana Celia Harris, Lawyers Committee for Civil Rights, Broward Poll workers only had a list of voters for their precinct and did not help regarding those not on their list. The S.O.E. websites and phones were down and people could not get through to find out where they were supposed to vote or with other questions. It would have been easy to have provided this information but it was not done.

EP Hearing(affidavit), Ellen Brodsky, Verified Voting, The Broward vote machines were not properly tested. There were 58,000 missing absentee ballots that voters did not get. Large numbers were not allowed to vote by regular ballot so it is clear that large numbers were not allowed to vote by provisional ballot as they should have been since only about 2,000 provisional votes were counted.

EP Hearing(affidavit), Mary Peeler, NAACP, The NAACP received many complaints of many people in Florida not allowed to vote- many unable to get absentee ballots, people refused provisional ballots incorrectly, because of long lines in early voting due to not enough sites and not enough workers, by improper exclusion of those without IDs at poll, and by non-uniform policy regarding provisional ballots.

EP Hearing(affidavit), Randall Marshall, ACLU, Thousands of voters were affected by problems getting absentee ballots in South Florida. Also large numbers were denied their right to vote by poll workers improperly not letting those who had requested absentee ballots but never got them or didn’t choose to use them from voting using a provisional ballot. The Broward County Supervisor of Elections showed little concern over such issues in her testimony regarding election problems.

Beverlye Neal, State NAACP, many thousands had been purged from the voter roles improperly and have not had their registrations restored. There were long lines in early voting and long lines in minority precincts. Not enough working machines or workers.

We staffed the emergency hotline for the Kerry Campaign Headquarters in Broward County from late October through the election. We had calls about a road block, put up by the police at 7am on Nov. 2, which blocked road access to two precinct locations in majority black districts. There was no justification for the road block--no accident or crime scene or construction. Many of our calls dealt with voter suppression, or manipulation, of the Haitian population--occurrences which seem too numerous, and their targets too indefensible, as primarily poor, first-time-voter, Creole-speaking refugees, to be anything but systemic. In one example, a voter whose hands were bandaged could not press the touch-screen himself; he asked the nonpartisan election official to press "Kerry" for him, but the election official pressed "Bush" and sent his vote immediately into the machine. Many, many others were denied the right to vote and were not given provisional ballots, while others were refused assistance at the polls, even though provisional ballots and voter assistance are legal rights. Others were told they had already voted and were turned away, although they had never voted previously. This latter experience was a complaint not isolated to Haitians but also included other surprised voters with no recourse except their word against that of the Supervisor of Elections

Went down to Broward County office and they said they had mailed it to him 2 times before and would do it again. However, he asked his postman if he had seen any absentee ballots and he said he had not. Other people in the area are not receiving their absentee ballots even though Broward County says they are sending it out. Called Mail Fraud hotline - 954-436-7200 and reported this incident.
