013490 10/21/04, 10:40 AM PST Machine problem Royal Palm Beach Meeting Hall(#6098), 1050-A Royal Palm Beach Blvd, Royal Palm Beach, Palm Beach County County, Florida Woman went to vote and used electronic voting machine. The two presidential candidates' names came up on the screen, Bush was first and Kerry second. She said she carefully clicked on Kerry but the check mark appeared next to Bush's name. She called someone over to help her and that woman told her to check on the mistaken check mark and it would remove the check mark. Then she could try again and check on Kerry's name. She did and it worked the second time. She was concerned that it took her two times to get her vote right.

She called county BOE and confirmed her registration but they refused to mail her a voter registration card when she asked for one. She wanted to do early voting in case they gave her problems. Also reported that she heard on the news that when you push the button for Kerry on the voting machine, it comes up Bush.

Caller did not advance until correct vote registered - summery screen before voter cast showed correct vote - after "wrestling" with machine

For all other offices, she said the selection "took" easier. Also, the voter's husband's father reported that the workers at Aberdeen East Clubhouse in Boyton Beach were poorly trained when he took his mother for a provisional ballot.

045998 11/02/04, 3:48 PM PST Machine problem Coco Woods(#5070), Del Ray Beach, Palm Beach County, Florida Voter received a call on 11/1 from a woman claiming to be from the Democratic Party. The woman told the voter that her polling place had been changed to a location which was unfamiliar to voter. As it turns out, voter's polling place has not changed, and she was able to vote, but she was very disturbed by this call. Voted noted that she is an elderly Jewish woman, and she wondered whether there had been other voters in her community who had received these types of calls. Voter also indicated that she a lot of trouble w/ the touch screen machines. She had to press it repeatedly in order to get her vote recorded. She was ultimately able to do so, but she considered it a very cumbersome process.

The review screen initially displayed voter's choices, but then the screen flashed and the selections had completely changed. The voter went back through the selections to correct the changes and was able to cast vote correctly.

 

055994 11/12/04, 9:12 AM PST Machine problem 1501 Avenue U(#7031), Riviera Beach, Palm Beach County, Florida Machine #1 sticks, will not hold the vote as marked - switches after a number of tries, made intended vote sometimes hold. On the review of the ballot, many of the votes are erased. Machine #5 is still down. This is the second complaint on this machine in about 1 hour. There is someone in the polling place working on the other machine that is down but this machine is still being used.


 

055454 11/11/04, 8:12 AM PST Machine problem Boyton Beach St. John's Baptist Church (#7120), Boyton Beach, Palm Beach County, Florida Caller has difficulty reading, so she invited me to accompany her into the voting booth. Three times she touched the Kerry/Edwards frame on her screen and the machine did not highlight her selection. She was only able to correct this on the final screen that listed her selections. the "change" directions were very small and easy to miss at the top of the screen. Caller was able to vote for Kerry/Edwards usiing this screen. Which directed her back to the original screen presidential vote screen. This time the machine accepted her selection. [P]

EP Hearing(affidavit), voter Suzanne Goldstein in precinct 4176 of Palm Beach County on machine 21660,  voted for Democratic candidates and could see check marks by their names.  But when got to review screen all the results were republican, starting with Bush and Martinez.  Called the poll worker and EP and had poll worker Tony Enos and lawyer Jeffrey Stein confirm that Democrats were voted for but Review Screen showed all Republicans checked.  Mr. Enos suggested that I finalize the vote as it was and that the original punch would likely override the review screen results.   But I insisted on voting on a different machine and suggested that they take the faulty machine out of service.    The new machine appeared to function properly.

043648 11/02/04, 2:20 PM PST Machine problem; Other ballot-related problem; Other Heritage Park Clubroom(#5064), Delray Beach, Palm Beach County, Florida Voter states that polling place (a building) consisted or more than one precinct (ie tables). Voter approached voting tables for particular precinct. Voter given ballot than told to vote at a machine. Machines (10) were apparently not set up to distinguish b/w precincts (ie, a voter could vote at any machine - regardless of the precinct table at the polling place. Voting machines were all in the same room.) Voter asked if his vote would count if he voted on the "wrong machine" (ie a machine linked to a different precinct) and was told by the poll manager "I dont know". Voter believes that his vote may not count if he voted on the "wrong machine" -ie outside of his precinct. Believes that this is a way of getting people to vote on the "wrong machine" and therefore cancel their votes. Voter subquently videotaped the site and processes.

County, Florida Voter tried to vote "yes" on an issue and the "no" kept illuminating on screen. Voter called over a poll worker who hit the screen a number of times and finally got the "yes" to stay illuminated. Then at the end of the ballot when she tried to review her ballot, she found half the things she had voted for were not voted. She tried again and couldn't make it work. She voted as best she could.

Caller also noted that outside the precinct, there was a tally tape showing Zero ballots for precincts.[P]

In both cases, Castor was highlighted and selected, but when reached summary screen, it said Martinez. When they reported problem, poll worked laughed, did not seem interested in doing anything about it.

Reported via e-mail.  From staff of the emergency hotline for the Kerry Campaign Headquarters in Broward County from late October through the election. Many of the calls to our hotline were from voters who had pressed the "Kerry" button on their electronic voting screen, only to have "Bush" light up as the candidate they had chosen. In some cases, this would happen repeatedly until about the 5th or 6th time the voter pressed "Kerry" and eventually his name would light up. In other cases, the voters pushed "Kerry" but were later asked to confirm their "Bush" vote.

 

County Official: At least 21 voting machines in Broward County malfunctioned and were replaced Tuesday, and some votes on at least one of them might have been recorded inaccurately, election officials said.   An improperly calibrated machine at the polling place at 2501 Coral Springs Dr(#31E). in Coral Springs was used by an undetermined number of voters before it was replaced, said Carl Fowler, pubic information officer for Broward's Emergency Management Agency. If voters on that machine had reviewed their ballots before hitting the red "Vote" button, they could be certain their votes were recorded accurately, Fowler said.  However, if they did not review their ballots, it is possible that some votes were recorded inaccurately. If a machine is not properly calibrated, a vote intended to be cast for one candidate can be recorded for a different candidate.

As a citizen, and someone with a B.S. in Computer Science, I've been greatly concerned about the accuracy of electronic voting machines. Having worked with computers for decades in my own business, I know how vulnerable they are to both incompetence and tampering. So I always do everything I can to cross check and verify the numbers in my precinct, and the numbers in this election do not add up. 553 people voted on the machines in Precinct #11R, but the machines only registered 536 votes cast. Here are the details: I've worked with the same crew for a couple of elections now and we all care very much about making sure that everyone who is entitled to gets to vote, doing the best job we can to ensure the accuracy of their votes, making sure voters know how to use the machines, doing all the paperwork accurately and thoroughly, etc. Due to our Assistant Clerk taking sick early in the day on November 2, 2004, the Clerk asked me to take over as Assistant Clerk for Precinct 11R, and part of my responsibilities that day were to count and tally all the voting slips in our precinct. I was also directly involved with bringing up the ballots on the machines, preparing provisional ballots and affirmations for voters, logging those voters, contacting the elections office, and other tasks throughout the day. In this election we had 541 voters who signed the precinct registers. Additionally there were 14 people who were not on the registers who filled out pink affirmation forms; for these voters we called the elections office and got an approval code for each one, enabling them to vote on the machines. One person who signed a pink affirmation form voted with a provisional ballot rather than on the machine, which can be verified through the Clerk's Voters Log and also by looking at that voter's provisional ballot. So 13 people who signed affirmations voted on the machines. Each of these voters received a small slip printed on gold paper which was then given to an election worker, who brought up a ballot for them on the machine. Election workers also verified that each of these people had completed their ballot when they left the voting machine. There were also 18 people who voted with provisional ballots, these people did not receive the little gold paper slips and did not vote on the machines, so I am not including them in these tallies. Voters who signed affirmations or voted with provisional ballots were also logged into the Clerk's Voters Log and the numbers can be verified that way as well. We used a separate book of gold slips for the voters who signed affirmations so that can also be used to cross check the number of voters who signed affirmations and voted on the machines. All the various options with affirmations and provisional ballots these days make things a little more complicated and confusing. I tried to reconcile the numbers on election night but I could not, and this disturbed me greatly, but I thought perhaps I was just confused by all the variables because of the affirmations, provisional ballots etc. However, I looked at the numbers again the next morning, and the discrepancy in the numbers in our precinct can be distilled clearly as follows: The total number of voters in Precinct 11R who were approved to vote was: 541 - signed precinct register 13 - signed affirmations for a total of 554 voters. We had 553 gold slips returned, so probably one person left the precinct with their slip without voting, which could have easily happened as our lines both inside and outside were very long, and in the crowd near the front door, where the end of the line was for people who had already signed in and received slips, someone could have left without us knowing it. So these figures are consistent, we had 554 voters who were entitled to vote on the machines and received gold slips, and 553 of them did exactly that, as verified by these two different ways of counting voters, as well as by pollworkers who assisted them, collected slips and verified that each voter had completed their ballot. However, at the end of the night, the machines registered only 536 votes cast. That is a difference of 17 votes. 17 votes out of 553 is over 3% of the vote simply not counted. I have no way of knowing if there were additional problems with the accuracy of the votes cast, but it's clear that, at the very least, over 3% of the votes in Precinct 11R were not counted. All of the numbers detailed here were counted, recounted and verified by several pollworkers, and can easily be verified in several different ways using the paper records from our precinct. I kept the scratch paper where I made these calculations and can make that available if needed. Our original Assistant Clerk logged in the serial numbers of all the books of voting slips at the beginning of the day, and we both marked off each book of slips as it was used. So the number of gold slips used can also be re-verified that way. This log of voters' slips was returned to the Supervisor of Elections with the voters' slips (used and unused), affirmations, provisional ballots, precinct registers, Clerk's Voters Log and all other materials. Therefore please include Broward County, Florida Precinct 11R in your research and Freedom of Information Act requests. Please let me know how I can be of assistance with your work. If you need more information or clarification about my experience in the precinct, or if there is anything I can do here in Broward County, please let me know. It is very clear that the votes in my precinct were not counted accurately in this election, and that is unacceptable. She is driving to different precincts-- wants to report that zero tapes from ivotronics are printed as October 11 2004 -- the precinct is supposed to be dating the tapes October 18. She attended "Logic and accuracy testing" training-- none of the early voting machines were present at the Logic and Accuracy testing. None of the spanish language machines were present at the logic and accuracy testing. Most flagrant problems are at the Coconut Creek precinct at the North regional-BBC (Broward Communiyt College) Library(#38X,47X). She asked a series of questions and they wouldn't answer. She noticed issues re: absentee ballots. At the BCC Library they are accepting absentee ballots and they are putting them in an improper container and are handling the absentee ballots improperly. Today they won't tell her where absentee ballots are being stored, etc. They weren't logging in affirmations of early voters. Before the voting started, they are accepting absentee ballots at the early polling sites in violation of the regulations.

055833   11/12/04, 5:50 AM PST   Absentee-ballot related problem; Voter Intimidation   Curtis Parks, Miami, Miami-Dade County, Florida    A woman with the Bush Campaign came to the dining hall of Alapata Orlando Urra Community Center and gave out absentee ballots to a number of older women. The individual who provided the ballot said they would complete the ballot for each woman and then did so. The campaign workers had on Bush Campaign buttons. They were at the cafeteria several times. Some of the older woman wanted to vote for Kerry, but the individual insisted on voting for Bush. Workers also visited an apartment building named Santa Clara on 20th Ave & 12th Street. Many other cafeterias were visited as well. [P]

Poll worker said he had to enter phone number even though she did not want to. At 5 PM, voter received a phone call at the # written on the envelope asking for her by name (even though it was her mother's phone number). Caller asked voter who she voted for on provisional ballot. She tried to correct it by backing up, it told her that she hasn't voted for anyone in the County. She asked for help and the assistance was bad. She was not able to cast an electronic ballot (the machine spit out her card).

This is in a predominatly Black area. Polling people told them not to worry about it; said it had been happening all day.

The voter placed her vote for president and when she confirmed the vote for president a different name came up (Harris). The poll assistants were able to correct the mistake and the voter was able to vote for the correct candidate. Her final vote was for the correct candidate.

EP Hearing: Ms. Marcy Randolph( member of the staff at Senator Bill Nelson's Orlando office in charge of election issues)   On election day my office fielded several complaint calls from voters in counties with touch screen voting machines that their votes for Kerry were switched to Bush without their approval. When asked to enumerate the calls, Ms. Randolph indicated that the logs showed 15 calls about touch screen anomalies.

Detailed analysis of effects of apparent vote machine fraud and voter suppression in minority precincts in Palm Beach County:                             Based on voter reported irregularities to the EIRS election hotline(www.voteprotect.org)

 

Since only a relatively small portion of voters had the knowledge and motivation to report irregularities, only a small portion of total irregularities were reported,   but Florida had the largest number of reported irregularities of any state and the thousands of reported irregularities serve as a good paper trail of election fraud and irregularities in the 2004 election.

The analysis found that precincts with reported machines that were switching votes from Kerry to Bush had a significantly larger swing of the Dem vote percentage between 2000 and 2004 than the average for precincts without reported vote switching, with a swing of 6.8% on average.

 

The analysis found that precincts  with reported long lines or machine problems had a significant reduction in official vote turnout from the

2000 to the 2004 elections, with a swing of 7.8% on average for such precincts.   It seems ironic that precincts with extremely long lines correlated with extremely low official turnout compared to other precincts.    This would seem to imply that the low official turnout was due to the electoral system rather than voter apathy.      This consistently was found to be in minority precincts.

Exit poll data showed that a higher percentage of Democratic voters voted for Kerry in 2004 than for Gore in 2000, over 90%, and that Independent voters preferred Kerry by a significant margin.

 

   But while the Democrats had an 8 to 1 advantage in new registrations in Palm Beach County  between 2000 and 2004 and had a major get out the vote campaign,  the Republican vote total increased more than the Democratic vote total.   Similar occurred in neighboring Broward and Dade counties and in other touchscreen counties.
